Terms and conditions

1. Scope
These terms apply to the sale of vehicles and related services by ZAL Nutzfahrzeuge to businesses and – unless expressly agreed otherwise – to consumers. Deviating customer terms apply only if we expressly agree to them in writing.
2. Offers and conclusion of contract
Vehicle offers on the website and platforms are non-binding unless expressly marked as binding. A contract is formed only upon our order confirmation or delivery/registration of the vehicle. Prior sale remains reserved.
3. Prices and payment
Prices are shown including statutory VAT where applicable, or with a net amount in addition. The price agreed in the purchase contract is decisive. Payment terms are agreed individually. Retention of title applies until full payment.
4. Handover and transfer of risk
Place and time of handover follow the purchase contract. Risk passes to the buyer upon handover, unless mandatory consumer protection rules provide otherwise.
5. Warranty and condition
Used vehicles are sold – where legally permitted and individually agreed – under exclusion of liability for material defects (“as inspected”), except fraudulently concealed defects and guarantees. Consumers retain statutory warranty rights; deviations only within the legally permitted scope. Listing details are descriptions, not guarantees of quality.
6. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of essential contractual duties and limited to foreseeable typical damage. Product liability remains unaffected.
7. Export and registration
For export transactions the buyer is responsible for customs and foreign-trade compliance and for obtaining required permits unless expressly agreed otherwise.
8. Governing law and venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Venue for merchants is – where permitted – the registered seat of ZAL Nutzfahrzeuge.
9. Severability
If individual provisions are invalid, the remaining provisions remain effective.
